Leap Year Wedding Contest (“Contest”) – Official Rules

THIS CONTEST IS VOID WHERE PROHIBITED BY LAW AND OUTSIDE THE STATE OF FLORIDA. This promotion is not administered by, sponsored, endorsed, or associated with Facebook. GENERAL GROWTH MANAGEMENT, INC. (“Sponsor”) is the sponsor.
Entry Period: enter between January 11, 2012 and January 24, 2012 ("Entry Period").
Eligibility Exclusions: Employees, their immediate family members and those living in the same household, of General Growth Management, Inc., [Clear Channel Radio/WXXL] (“Marketing Partner”), and their parent corporations, subsidiaries, and affiliates (collectively the “Sponsor or its Agents”) are not eligible to participate.
How to Enter/ Eligibility: Limit one entry per entrant (“Entrant”). To enter, log on to [www.xl1067.com] (the "Contest Website") during the Entry Period and submit the following (collectively, the “Submission”):
● a brief essay, in English, that communicates in 500 words, or less, how Entrant met their finance and why they want to get married at the Mall;
● a digital photo of the Entrant and their fiancée (together the “Couple”);
● the official entry form including entrant’s information (who must be 21 or older, a legal U.S. resident, and a legal residents of Florida, and engaged with the ability to present a valid marriage license within four days of Sponsor’s win notification) along with their fiancée’s information (who must be 21 or older);
● an acknowledgement statement including an agreement that the Couple (if deemed the winner) will be married at the Mall on Feb. 29 2012 (“Ceremony”) and that they are eligible to be married in the state of Florida.
Please note: content provided in the Submission will not be made public on the Contest Website during the Entry Period. However, the Sponsor and its Agents will have the right to use the winner’s Submission in marketing collateral as stated below.
The Contest shall be subject to these Official Rules, and by entering, the individual entering agrees to be bound by the terms and conditions herein. To be an eligible Entrant, the Couple must be engaged and be willing and available to participate with the Sponsor or its staff in certain pre-Ceremony activities and to participate in a Ceremony incorporating the elements set forth below. Each member of the Couple must also be willing to authorize, undergo, and cooperate with a background check if requested by Sponsor.
Judging: Submissions will initially be judged by a panel of judges from the Marketing Partner based on the following criteria: 50%: entertaining or unique story; 25% the mall is presented in an attractive way (either in the story or the photograph); 20% creativity and originality; 5% spelling and grammar. Entrants whose Submissions have the highest scores will be deemed the finalists and together with their fiancée they will be deemed a “Finalist Couple”. There will be 5 Finalist Couples. The Sponsor will determine which Finalist Couple is the winner and this decision will be made based on the same criteria stated-above. Becoming the winner is based on the total number of eligible entries received and on the quality of a Submission.
Win Notification: Sponsors will attempt to notify a winning Entrant by telephone or by e-mail (“Win Notification”) on or about Jan. 27, 2012. If an Entrant cannot be contacted or does not respond within [insert no., i.e. two] days of the Win Notification or if one or both members of a winning Couple do not fulfill the eligibility requirements, if one or both members of a winning Couple cannot adhere to the Official Rules, or if the prize notification is returned as undeliverable, the Entrant will be disqualified, all prizes will be forfeited and an alternate winner will be selected. In the Event the winner forfeits the prize the Sponsor will alert the remaining Finalist Couples of their status and the Sponsor and communicate their status as possible winners.
Required Documentation: As a potential winner, each member of a Finalist Couple will be required to sign and return an Affidavit of Eligibility, Liability & Publicity Release and such other documents as required by Sponsor or its Agents. Failure to return all such documents within 4 days of receipt of same may result in the Finalist Couple being disqualified and another Finalist Couple being selected, provided time allows. Also, the final winning Couple will be required to produce the following within 4 days of notice: i) a marriage license in the timeframe indicated that allows the Finalist Couple to married at the Mall on the date stated; ii) a complete guest list (collectively the “Prize Acceptance Confirmation”) to the Sponsor.
Public Voting for Elements of the wedding: There will be a public voting component to this Contest that will determine certain elements of the prizes or Ceremony (“Details”) and Facebook fans (“Fans”) will be encouraged to vote on these Details. Entrants understand that Fans will be given options to vote on and the winning Couple must agree to incorporate the Details that receive the most votes in each category. Voting on the Details will occur between [insert dates]. By entering, each Entrant agrees, if selected as the winning Couple, to: i) participate in various pre-ceremony activities which may include fittings, engagement photos, presentations, styling sessions, etc. ; ii) to abide by the results of the online voting as determined by the Fans; iii) that the Sponsor has the authority to make the final decisions concerning all aspects of the promotion and Ceremony; iv) and to attend and participate in the Ceremony. If one or both members of the winning Couple do not abide by these Official Rules or do not participate in the activities requested by Sponsors, the winning Couple will forfeit the Grand Prize.
Grand Prize: The Grand Prize includes the following:
● Bridal Attire (up to a $500 value) provided by Macy’s;
● Bride and Groom wedding bands (up to a $500 value) provided by Zales;
● Photo Album (up to a $150 value) provided by Claire Pacelli Photography LLC;
● Tuxedo rental for Groom (up to a $180 value) provided by Men's Wearhouse and Tux;
● $1500 in Southwest Vacations gift certificates (destination and hotel will be booked by the Winning Couple after the Ceremony);
● $500 Shop Etc. mall gift card.
Total prize value: $3,330. All prizes, except the photo album, will be awarded the day of the Ceremony (the gift card and Southwest certificates will be given after the conclusion of the Ceremony). The photo album will be available at the Mall after the professional photographer develops the images. Ceremony will be held at the Mall on Feb. 29, 2012 and performed by an officiant provided by the Sponsor (or if the winning Couple prefers, they may provide the officiant at their expense) between 6pm-7pm. Mall will host an event directly following the Ceremony for up to 75 guests at Mall between 7pm-9pm (extra guests will be at the expense of the winning Couple and only if the Sponsor allows). All expenses not specifically listed herein are the responsibility of the winning Couple. Prizes are not transferable or redeemable for cash, and prize substitution will not be allowed, except at the sole discretion of the Sponsor. The approximate retail values (“ARV”) stated-above are estimates and winners will not be entitled to compensation if the actual amount varies. Properly claimed prize will be awarded, but in no event will Sponsors award more prizes than are provided for in these Official Rules.
Reservations and travel must be accepted and completed as determined by Sponsor or as communicated on any given gift card or travel certificate. Restrictions may apply including expiration dates, restricted dates, and blackout dates. Winner is responsible for any costs/expenses not specifically listed above including, but not limited to, taxes, meals, transportation, gratuity, and all personal expenses, and other incidentals. Gift cards, tickets and vouchers may be subject to the terms and conditions of the issuer, including service fees and purchase restrictions. Sponsor and prize providers reserve the right to further restrict or alter prizes. The Grand Prize must be accepted as described-above and may not be sold or transferred and is not convertible to cash. No prize substitutions allowed except by Sponsor, who reserves the right to substitute a prize of equal or greater value. Sponsor and its Agents reserve the right to require I.D. or additional documentation from the guests who wish to attend the Ceremony. Additional prize restrictions and terms may be imposed by prize providers. Ceremony date and time is predetermined. Sponsor is not obligated to provide the winner with an alternate prize if Winning Couple does not attend Ceremony or attend other pre-Ceremony Activities. If the Ceremony is canceled due to circumstances beyond the Sponsor’s control, the winner acknowledges that the Sponsor will only provide the Grand Prize as described above and only if the Winning Couple complies with these Official Rules. The Sponsor reserves the right to award a prize in the amount of $500 in Shop Etc. gift cards to the next Entrant with the highest score, in lieu of any other prize awards and in full satisfaction of this Contest, if the unverified Winning Couple who was asked to accept the prize on or before 2/13/2012 chooses not accept the prize by the date communicated by the Sponsor; this determination is solely the decision of the Sponsor.
Other Conditions: Each member of the Couple represents and warrants as follows: that the Submission is the original creation of one or both members of the Couple, has not been copied in whole from any other work, has not been previously published, has not been previously submitted in another contest, does not violate the rights of any other person or company (including but not limited to privacy rights and copyrights), as determined by Sponsors. Essays must be in English. Essays that do not comply with these Official Rules shall be disqualified. Entrants agree to indemnify, defend and hold Sponsors harmless against any and all liabilities, losses, damages, claims, debts, investigations, fines, penalties, costs, expenses and settlements (including attorneys' fees and costs of litigation, settlement, judgment, interest and penalties) arising out of or related to a breach of the foregoing representations and warranties. Entrants grant to Sponsors a world-wide, perpetual license to use their Submissions in any manner related to the Contest, without prior notice, approval or compensation, including but not limited to the first right to publish the Submission in any medium. Winners are responsible for cancelling prior arrangements to accommodate the Ceremony schedule and any such cancellation fees are to be paid by the Couple. All entries become the property of the Sponsors and will not be returned or acknowledged. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry and has met all eligibility requirements. Entrants agree that all decisions made by the Sponsor or its panel of judges relating to any and all issues related to this Contest are final and binding. Submissions may be judged on a rolling basis.
Finalist Couple Notification: All Finalist Couples may be notified by the Sponsor via telephone or e-mail. If a selected Finalist Couple cannot be contacted or does not respond to the Sponsor within 2 days, if one or both members of a Finalist Couple do not fulfill the eligibility requirements, if one or both members of a Finalist Couple do not adhere to the Official Rules, or if the Win Notification is returned as undeliverable, that Finalist Couple will be disqualified, all prizes will be forfeited and Sponsor may select a new Finalist Couple, time permitting.
Release: By entering, each member of the Couple on their own behalf, and on behalf of their family, friends and invitees, agrees to release, waive, and hold harmless Sponsors or it Agents and their affiliates, subsidiaries, parent companies, prize providers, Marketing Partner, Facebook, advertising, and promotional agencies, and all of their officers, directors, shareholders, employees and agents from and against any and all claims, losses, damages, and liability arising from injuries, damages, costs, or expenses of any kind (including without limitation attorney's fees) incurred as a result of the contestant's participation in this Contest and/or acceptance, use, or misuse of the prizes.
Terms & Publicity: By entering this Contest, each member of the Couple agrees to allow use of their name, voice, photograph, likeness, video appearance and any information provided on the entry form, and their essays, in any medium of communication, including but not limited to print, Internet, radio and/or television and for any purpose, including advertising, promotional or other purposes, by Sponsors and their licensees and affiliates, without additional compensation. Entrants may also be asked to participate in certain events in an effort to publicize the Contest. Couple must acknowledge that Mall management has the final decision concerning all aspects of this Contest or any event taking place at the Mall and although every effort will be made to provide the items voted on by the Fans the possibility exists that the Sponsor will need to replace those items with something of similar value if the prize provider cannot provide a given item, the Sponsor is the only party who may substitute any item allocated to Sponsor by its prize providers. Federal, state and local taxes are the sole responsibility of the Entrant who will receive a 1099 tax form reflecting the actual value of the prize and will be required to complete and execute tax related documents. Sponsor will allow the Entrant to split the tax liability equally with their fiancée provided the fiancée completes and executes all documentation requested by Sponsor within the time communicated by the Sponsor. Failure to comply with these Official Rules will result in disqualification.
Internet: Sponsors or its Agents are not responsible for printing or typographical errors in any Contest-related materials; for entries that are lost, late, misdirected, deleted, incomplete, inaccurate, or garbled or entries that are processed, reported, or transmitted late or incorrectly or are lost for any reason, including computer, telephone, paper transfer, human or other error, or for electronic, computer or telephonic malfunction or error, including inability to access the Contest website, or process any transaction thereon. If for any reason this Contest is not capable of running as planned, or if this Contest or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper administration of the Contest and processing of entries in accordance with these Official Rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsors' opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest, the Sponsors reserve the right, at their sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Contest or any portion thereof. In the event this Contest is compromised and cannot operate fairly or according to plan, the judges panel will select three Finalist Couples applying the criteria set forth above to all eligible, non-suspect entries received prior to the event that compromised the integrity of the promotion. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE (INCLUDING THE ENTRY SITE) OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST WILL RESULT IN DISQUALIFICATION.
